Terms of Sale for Consumers

These terms apply when an individual consumer purchases a digital service directly from Gadder AS. The information presented during ordering forms part of the agreement. Statutory consumer rights apply regardless of these terms.

The total price and duration are shown before you order.

The right of withdrawal does not lapse without express consent where required by law.

You may make a claim if the digital service is defective.

1. The parties and the agreement

The seller is Gadder AS. The buyer is the consumer who places the order. The agreement consists of the order information, these Terms of Sale, the Terms of Use, and relevant product information.

Specifically agreed information takes precedence over general terms in the event of a conflict, to the extent that this does not restrict mandatory rights.

2. Service, price, and duration

The service's main features, total price including taxes, payment interval, access period, and any automatic renewal are clearly displayed before you order. There are no hidden charges.

If the order is for a subscription, the renewal and cancellation process is disclosed before purchase. Time-limited access ends when the stated period expires unless expressly agreed otherwise.

3. Formation of the agreement and payment

The agreement becomes binding when you complete an order that clearly states that payment is required. You will receive electronic confirmation. Obvious typographical or pricing errors are not binding if you knew or should have known that they were errors.

Payment is made using the method shown during ordering. The payment provider may authorize or charge the amount in accordance with the information presented at purchase.

4. Delivery

The digital service is delivered when the feature or access becomes available to your account. Delivery normally occurs immediately after payment is approved unless a different time was stated before ordering.

5. Right of withdrawal

For distance sales, you generally have a 14-day right of withdrawal beginning when the agreement is entered into. Before the deadline, you may use the standard withdrawal form at /angreskjema, use the form provided with your order confirmation, or send us another clear statement of your decision to withdraw.

Energiplan Tilgang is a time-limited digital service. If you expressly ask us to begin providing the service before the withdrawal period expires and later exercise your right of withdrawal, Gadder may charge a proportionate amount for the portion provided before we receive your notice, provided all statutory conditions are met. The right of withdrawal lapses only after the service has been fully performed if you both requested early performance and acknowledged in advance that full performance would cause the right to lapse.

For any separate purchase of digital content not supplied on a physical medium, the right of withdrawal lapses only when delivery begins after you have given express prior consent, acknowledged that the right will thereby lapse, and received the legally required confirmation. The purchase alone does not constitute this consent.

6. Delay

If the service is not delivered at the agreed time for reasons not attributable to you, you may demand delivery, withhold payment, terminate the agreement, and claim damages subject to applicable law. Contact us first so we can investigate and correct the issue.

7. Defects and claims

The service must conform to the agreement, provide the promised functionality, and receive necessary updates. If the service is defective, you may be entitled to have the defect remedied or the service replaced, receive a price reduction, terminate the agreement, or claim damages under the Norwegian Act relating to the Provision of Digital Services to Consumers (digitalytelsesloven).

Notify us within a reasonable time after you discovered or should have discovered the defect. Notice given within two months after discovery is always considered timely.

8. Cancellation and refunds

Canceling a subscription prevents future renewals in accordance with the information presented during ordering. Cancellation is not the same as exercising the right of withdrawal or making a defect claim.

If you validly exercise the right of withdrawal or terminate the agreement for cause, we will issue a refund under the rules and deadlines of applicable law, normally using the original payment method.

We process personal data to enter into and perform the purchase agreement, provide the service, and comply with legal obligations. See the Privacy Policy for complete information.

10. Complaints and disputes

Contact us to make a claim or complaint. If we cannot resolve the matter, consumers may request mediation from the Norwegian Consumer Authority. Where applicable, the matter may then be reviewed by the Consumer Disputes Commission. These terms are governed by Norwegian law, without depriving you of protection granted by mandatory law.
